Terms, Conditions and Warranty

This is an agreement for all Xprobots LLC sales and both parties must agree.

Xprobots as a company prides itself on its contribution to the packaging industry by providing customizing machines with an excellent technology that fit your needs.

One year warranty on non-wearing parts.
3 weeks or guarantee in return in case of replace or devolution. This warranty covers only if the machine fails to do its job. Xprobots Raises the standards of the industry by investing in technology and optimal performance of each customized machine.
This warranty applies to the original purchaser.
If a warranty claim is made, we will have the opportunity to examine the equipment. If there are any manufacturing defects Xprobots will repair or replace, as applicable.
Xprobots is proud to offer its customers free training via internet and free telephone consultation with our specialized technicians on an indefinite basis.

Xprobots Machinery

Prices: All our prices are competitive in the market according to the value of our product, considering customer needs, market and our contribution to the industry.
Terms: A full payment for the machines or the parts is required prior to the start of production. Some of the parts are already in stock and will be shipped within the next 3 days of the purchase order, the parts that are not in stock will take from 1 week to 12 week to receive them depending on the complexity of the part, once it’s in stock it will take 3 days to send to the customer. Once the machine is completed and the customer has knowledge of the machine’s operation, either by conference call, videos or attendance at our warehouse. If multiple orders are placed on the same receipt and the customer requests separate installation, the total balance per machine must be deposited prior to each installation.
Payment is bank to bank (wire-transfer or ACH) once the payment is received the production process of the machine starts.
Taxes and fees: In addition to the price invoiced by Xprobots as mentioned. All applicable sales, use or other taxes (notwithstanding their designation as excise, gross receipts, privilege or similar taxes) imposed by any governmental body upon the transaction described herein. All additional costs arising from any duties and any federal, state or local laws imposed as processing or any other taxes on the raw materials or manufactured products.
Delivery: Customer is responsible for shipping and handling cost. The estimated delivery time is 8 to 12 weeks purchase order, deposit and samples. Once received, the order will be placed. All scheduled delivery dates are approximate, subject to change due to weather, conditions, war, fire, strikes, and external situations. Xprobots will not be responsible for delays caused by common transport once delivery has been made to the point of manufacture.
Samples: The buyer must supply the requested quantity of bottles, caps and sample products as requested Xprobots. The buyer guarantees that the product samples will be non-flammable, explosive or toxic.
Testing: Xprobots will test the machines with two (2) combinations of bottles and products, Or two (2) combinations of bottle and cap. Additional tests will be charged at $200.00 per container.
Storage: Xprobots machinery will allow up to 3 weeks for the buyer to arrange shipment once the FAT have been completed and the machines have been packed. After the 3 week period the storage costs will be in force if the machines are still in the Xprobots warehouse. The purchaser must make a payment of $100 per machine per month at the Xprobots facility.
Cancellation: In order to assist you in making the cancellation effective, a formal written document to Xprobots Company is required. In case the customer cancels the order before the installation date, the 50% of payment will not be refunded. Xprobots LLC does not accept cancellations for any reason other than machine malfunction of the machines during the first 3 weeks of the warranty period.
Choice of Law: All matters arising out of or relating to this agreement shall be governed by the laws of the State of Florida (exclusive of conflict of laws principles), and shall be deemed to be performed in Miami, Florida. Any legal action or proceeding relating to this agreement shall be instituted only in a state or federal court in Miami-Dade County, Florida. Xprobots and Buyer agree to submit to the jurisdiction of, and agree that venue shall only be proper in, these courts in any such legal action or proceeding.
Installation: Xprobots is responsible for the installation of the projects. Xprobots is responsible for any damage to equipment or property, or any consequential damages, arising from the connection with such installation caused by any Xprobots’s employees. The machine has been prepared for use with samples sent to Xprobots. Installation and training are provided by Xprobots at an additional cost. Training is provided at our Miami facilities at no cost prior to shipment of equipment. If installation is requested, the buyer is responsible for placing and leveling the equipment and making all service connections (air, water, electrical, etc.) prior to the arrival of the technician. On-site training and installation fees are as follows: Time of service regular rate, 8 hours per day Monday through Friday during a 24-hour period: $100 per hour. Overtime rate of service, additional hours beyond 8 hours Monday through Friday during a 24-hour period: $142.50 per hour. Additional expenses, hotel, travel and other applicable costs will be applied to the order on separate invoices.
Limitation of Liability: Xprobots will not be liable for any loss of time, loss of income or profits, loss of product or material, good will or any other consequential damages that may be caused by the malfunction of this equipment.
